The Client is required to read the Legal Information provided herein. By accessing www.valuetree.es and any websites related thereto, the Client is deemed to have fully accepted the General Terms of Use of the Website in force at the time of access.
VALUE TREE reserves the right to modify, update, or remove these General Terms of Use of the Website, as well as any specific or general terms, rules of use, notices, or instructions that may be applicable, at any time. Likewise, VALUE TREE reserves the right to suspend, interrupt, or discontinue the operation of the Website at any time.
The Client’s express acceptance implies that any future amendments to these Terms shall become binding upon the Client from the moment they are published on the Website. Clients are therefore encouraged to review these Terms periodically.
The services offered by VALUE TREE are primarily intended for investors who are resident in Spain. Any legal entity or individual resident or domiciled in another Member State of the European Union or outside the European Union must ensure that access to and use of the Website and/or its contents are permitted under the laws applicable in their own jurisdiction.
Any request for, or submission of, information regarding the services offered by VALUE TREE through this Website by a user who does not meet the Spanish residency requirement and who has not requested such information in accordance with the procedure indicated above shall be deemed to have been made solely at that user’s own risk. Governing Law and Jurisdiction
All services offered and content made available on this Website are provided by VALUE TREE in accordance with the laws of Spain.
As a general rule, all relationships between VALUE TREE and its clients arising from the provision of services available through this Website shall be governed by Spanish law and subject to the exclusive jurisdiction of the Spanish courts.
Partial Invalidity
Should any provision of these General Terms be declared null, void, or unenforceable by a competent court, such declaration shall not affect the validity or enforceability of the remaining provisions, which shall remain fully binding upon the parties.
The failure of either party at any time to enforce any provision of these General Terms shall not constitute a waiver of that provision or of any other provision, nor shall it create any rights in favour of the other party.
Registration as a VALUE TREE Client
Users are hereby informed and expressly acknowledge that submitting an application to become a VALUE TREE client or requesting the subscription of any products or services offered through this Website shall not, in itself, establish a commercial relationship with VALUE TREE A.V., S.A. Such relationship shall only arise once all requirements established by VALUE TREE A.V., S.A. in accordance with the applicable regulations have been fully satisfied.
VALUE TREE reserves the right, at its sole discretion, to accept or reject any client registration request. Registration shall not create any obligation on the part of the Client to use the services offered.
Fees
All fees applicable to the services provided by VALUE TREE shall be subject to the pricing schedules and conditions made available to users at all times on this Website. These are available through the “Schedule of Fees” information brochure.
Security
All access to transactional pages through which Clients subscribe to any of VALUE TREE’s services is carried out within a secure environment.
The services offered by VALUE TREE through this Website may be requested and/or contracted online using a system of passwords and security codes provided by VALUE TREE, thereby ensuring client identification and the integrity and confidentiality of all transactions.
The Client undertakes to maintain the strictest confidentiality regarding their access credentials and any other applicable security measures.
VALUE TREE A.V., S.A. shall not be liable for any loss or damage arising from the improper, incorrect, negligent, or unauthorised use of the access credentials provided by VALUE TREE, nor for any failure by the Client to take appropriate precautions to prevent the loss, disclosure, alteration, unauthorised use, transfer to third parties, theft, or misappropriation of such credentials, or any act or omission by the Client that may facilitate fraudulent activity.
Client Guarantees
When subscribing to any service offered by VALUE TREE via the Internet, the Client shall be entitled to:
(i) Reproduce the General and Specific Terms and Conditions applicable to the contracted service by printing, downloading, transferring, or saving them to the Client’s computer or any other durable medium for storage and future reference.
(ii) Request that the aforementioned General and Specific Terms and Conditions, or evidence thereof, be sent to the postal or email address provided by the Client for that purpose, or request delivery of such documentation in paper format or on a digital storage medium at any VALUE TREE office or customer service centre.
(iii) Consult the General and Specific Terms and Conditions at any time through the online archive made available by VALUE TREE to its clients at www.valuetree.es. VALUE TREE A.V., S.A. may unilaterally amend these General Terms and Conditions by publishing the revised version on www.valuetree.es at least fifteen (15) days prior to their effective date.
(iv) Receive all relevant information relating to the contracted services, with the ability to access and review such information online and to request any clarification or additional information from the service provider.
(v) In accordance with Law 44/2002 of 22 November on Measures for the Reform of the Financial System, VALUE TREE provides its clients with the services of a Client Ombudsman, who shall be responsible for handling all complaints and claims submitted by clients concerning their legally recognised rights or interests.

Commercial Information
